Registering in the tax census (censo) as a new resident
Explains what the tax census is, when you are entered in it without doing anything, and when you must file a form yourself. Written for newcomers who have, or are about to get, a Spanish tax number.
Terms used
- NIF — The NIF is the tax identification number; for foreigners it is the NIE, for Spaniards the DNI number.
- NIE — The NIE is the identification number Spain gives to foreigners, used for tax, work, housing and official procedures.
- DNI — The DNI is the national identity card for Spanish citizens, whose number also serves as their tax ID.
Key rules
- Automatic entry: An NIE or DNI puts you in the census without any form.
- Modelo 030: Use it if you have no business activity and need a NIF or must change your tax address or personal data.
- Self-employed: Use Modelo 036, or the simplified Modelo 037, instead of Modelo 030.
- Employees: Employer withholding does not replace your own duties, such as the annual return if you pass the thresholds.
What the census is
The censo is Spain's register of people and businesses with tax obligations. The tax authority (AEAT) keeps it. Being in it gives you a tax number (your NIF), records your tax address (domicilio fiscal) and lists your tax obligations. If you run a business, it also records your activity.
When registration is automatic
For most newcomers it happens without a form. You are entered in the census when:
- the police or the Ministry of the Interior assign you an NIE;
- a DNI is issued to you;
- an employer, bank or notary reports you to the AEAT.
Social Security registration also feeds the system. So if you already hold an NIE or DNI, you are already in the census and do not register separately. Once you live in Spain, set your Spanish tax address with modelo 030: it counts as an address change, so file within three months of moving in. The rules are the same whatever your nationality, including EU citizens, non-EU citizens and UK citizens with Withdrawal Agreement rights; only your identity document differs.
When you must act yourself
Automatic entry does not cover everything. You must file a form if you:
- need to request a NIF and do not have one yet;
- need to change your tax address or fix personal data the automatic entry lacks;
- start a business or professional activity.
A new tax address has its own clock: three months on modelo 030, or one month on modelo 036 or 037 for a business. Your tax address explains who uses which.
Which form to use
Modelo 030 is for individuals with no business or professional activity. Use it to register, request a NIF where needed, or report a change of tax address or personal data. You file it online on the AEAT website with a digital certificate or Cl@ve, or in person at an AEAT office, where you usually need a prior appointment. Register for Cl@ve first; a digital certificate does the same job for filing.
Modelo 036 is for anyone who starts self-employed activity. Modelo 037 is the simplified version, for people who meet certain conditions and use no special schemes. The form asks for your activity heading, how you pay income tax, your VAT regime and the returns you must file.
Filing Modelo 030, 036 or 037 costs nothing: no fee and no payment form apply.
If your employer withholds tax
You do not need a separate registration for the job, because your employer reports your pay. But withholding is only an advance payment. You may still have to file the annual income tax return (IRPF), for example if you have more than one payer and pass the income limit. Keep your tax address up to date too.
If you work remotely for a foreign employer or you found a company
- Remote worker for a foreign employer: You need an NIE, and it puts you in the census. File Modelo 030 for address changes. No Spanish employer withholds tax, so you file the annual IRPF return yourself.
- Company founder: Your company uses Modelo 036, not Modelo 030. A newly formed company requests a provisional NIF with Modelo 036, filed by its legal representative. It gets a definitive NIF after incorporation in the Registro Mercantil.
If you are a retiree, a non-resident owner or a couple
- Retiree with a foreign pension: Your NIE puts you in the census and no activity form applies. You declare the pension in your Renta, not at registration: how foreign pensions are taxed.
- Already holding an NIE as a non-resident, for example from buying property: It is the same number, so you are already in the census. When you start living in Spain, set your Spanish tax address with modelo 030; from your first resident tax year you file the Renta instead of modelo 210.
- Non-resident who owns property in Spain: You need an NIE as the owner, and you file modelo 210 for the property each year instead of the Renta: the non-resident return.
- Couple: Each partner has their own NIE and is in the census separately. A married couple chooses each year between one joint Renta and two separate ones; see joint or individual filing. Whether you are a tax resident is decided by the residency tests, not by registering.
