Getting work rights if you hold a non-lucrative residence
Explains whether you can move from a non-lucrative residence to a work permit without leaving Spain, and what you need first. It is for non-lucrative holders who want to work or become self-employed.
Key rules
- No work yet: A non-lucrative permit does not allow any work until your switch is approved.
- Switching in Spain: Since 20 May 2025 you may be able to switch to a work permit without leaving Spain.
- Minimum time: You need about one year of legal stay on the non-lucrative permit first.
- Job basis: You need a job offer, a contract or a self-employment plan, and a clean criminal record.
The exact conditions, including the minimum time and the employment situation test, should be confirmed with the immigration office before you apply.
Can you switch without leaving Spain?
Yes, in some cases. A non-lucrative residence does not let you work, and that has not changed. But since 20 May 2025, holders can apply to change to a work permit from inside Spain, after a minimum time here. Before that date, this was possible only in limited cases.
Until the change is approved, do not work, including for a short trial or a freelance job. Working without permission can put your residence at risk.
When you can switch
You need to have been legally in Spain on the non-lucrative permit for a minimum period, about one year. Your permit must still be valid when you apply. If it is close to expiring, ask the immigration office how a renewal and a switch interact before you file.
What you need besides time
- A job offer, a contract or a self-employment plan.
- No criminal record.
- An employer who meets the usual employer and Social Security requirements, if you will be employed.
The employment situation test
For some jobs, Spain checks whether the post could be filled from the local labour market. This is the national employment situation test. It may apply to your job unless an exception covers you. Ask the immigration office or an immigration adviser whether your job is exempt before you rely on an offer.
What to do next
- Count your time on the non-lucrative permit.
- Secure the offer, contract or plan.
- Ask your employer to confirm they meet their requirements.
- Check the employment situation test for your job.
- Apply only when all of this is in place.
The checklist and the questions below cover these steps in more detail.
