Switching from employee to self-employed residence
How to move from an employee residence permit to self-employed residence in Spain without breaking the rules. For foreign employees who want to start freelance or business work and need to know what to prepare and when they may start.
Key rules
- Authorisation: You need an authorisation to change to self-employment, and you should apply before you start freelance work.
- Timing: File while your current employee permit is still valid.
- Business plan: Your plan must show investment, jobs created and income enough to support you and your family.
- Refusal: If the switch is refused, you must stop working under it.
The minimum time on your permit and the date you may start working are not confirmed here, so check both with the Oficina de Extranjería before acting.
The short answer
You cannot simply start freelance work on an employee permit. You need an authorisation to change to self-employment, you must have held your current permit for some time, and you need a viable plan for the activity. Apply before you start working for yourself.
Who can apply
You can apply from inside Spain if your employee permit is valid and current. You must be in a regular situation, have no criminal record and meet the general requirements for self-employment.
You usually need to have completed some time on your initial permit first. The exact minimum time is something to confirm with the Oficina de Extranjería before you file.
File while your current permit is still valid. Do not wait for it to run out.
What you need to show
The core of the application is a viability or business plan. It should show:
- the investment you expect to make,
- the jobs the activity will create,
- income enough to support you and your family.
You also need proof of your funds or investment. If your activity needs licences, registrations or professional qualifications, you need those too. Where the profession is regulated, you need membership of its professional body. In some cases a regional or sector body must report on whether the plan is viable.
The documents list below shows what to gather. The exact list varies by activity and region, so ask the Oficina de Extranjería what applies to yours.
When you can start working
Under the 2025 rules, in many cases you can start the new activity once your application has been admitted for processing. You do not have to wait for the final decision. Admission usually comes soon after you file. This only applies if you filed in time and meet the conditions.
If the switch is refused, you must stop working under it. So keep your plan and savings realistic, and do not commit money you cannot afford to lose before you have a decision.
After the switch is granted
Register in RETA, the self-employed scheme of Social Security. Also register your activity for tax with Hacienda using form 036 or 037. The deadline is set in the grant, so read the notification carefully. Under the previous rules the activity had to start within about three months of the grant notification. Check which rule applies to your case.
The timeline below sets out the order of steps.
Timeline and deadlines

File your switch to self-employment while your current permit is still valid: before your current permit expires

-
Register in RETA with Social Security and register for tax with Hacienda (form 036 or 037): within the deadline set in your grant
