Proving status during a pending renewalArticle 1 of 4 · 7 min read
Documents that prove you are legal while your renewal is pending
If your residence card has expired but your renewal is pending, you can still prove you are legal. This page explains which receipt and notices to show, and the timing condition that makes them count. It is for foreign residents renewing a permit in Spain.
Terms used
- NIE — The NIE is your personal foreigner identity number. It stays the same for life, even when your residence card expires.
- Justificante de presentación — The justificante de presentación is the receipt you get when you file, showing the filing date and file number.
- Admisión a trámite — The admisión a trámite is a notice that your application has been accepted for processing.
- Acuse de recibo — The acuse de recibo is an acknowledgement from the administration that it received your application.
- Requerimiento — A requerimiento is an official request to send missing documents.
- Certificado de situación del expediente — The certificado de situación del expediente is a letter from the office stating the current status of your file.
Key rules
- Proof of status: Show the filing receipt or admission notice together with the expired card and your passport.
- Filing window: You can file during the 60 days before the card expires and up to 90 days after, but only filing before expiry keeps your status unbroken.
- Missing documents: If the office asks for missing documents, you normally have 10 days to send them, or the file can be archived.
- Certificate: No standard extension certificate exists, so do not wait for one.
What proves your status with an expired card
If you filed your renewal in time, your permit stays valid until the office decides on it. Your proof is the filing receipt or the admission notice, shown together with the expired card and your passport. The extension also covers the rights your permit gave you, including the right to work if it had one.
This only works if you filed on time. Filing before the card expires keeps your status unbroken.
The documents, in the order you get them
- Filing receipt (justificante de presentación). You get it when you file. It shows the filing date and the file number and proves the renewal was filed. Keep it safe from day one.
- Admission notice (admisión a trámite) or acuse de recibo. The administration sends it after filing. It shows the file is in progress and the extension applies.
- Requerimiento. This is a request for missing documents. It is not proof of status. Answer it quickly, because the file can be archived if you do not.
- Final resolution. This grants or refuses the renewal. It is a separate document and does not prove that your file is still pending.
The names and format of these documents vary a little by office and by filing channel.
Is there an official certificate of extension?
No standard certificate confirms the extension. In practice, the receipt or admission notice plus the expired card is what people show. Some offices will issue a letter on request. You can also ask the office that holds your file for a certificado de situación del expediente, in person or electronically. Whether they issue one depends on the office, so ask yours before you rely on it.
What if you filed late?
Filing within the 90 days after expiry is allowed, but you are in an irregular situation from the expiry date until you file. A fine is possible, and it is usually a fine rather than expulsion. Once the late renewal is admitted, the permit is treated as extended. After that window, the renewal is normally refused as out of time and you need a new authorisation.
Your NIE
Your NIE does not expire when your card does. It stays valid for tax, social security and bank purposes. What expires is the card and the right to stay and work that comes with it, which the extension then covers.
The timeline, documents list, checklist, warnings and FAQ below cover the deadlines and what to carry.
Timeline and deadlines
-
Earliest you can file the renewal: during the 60 days before the card expires
-
File before expiry so your validity is extended until the office decides: before the card expires
-
Collect the filing receipt showing the date and file number: when you file
-
Receive the admission notice or acuse de recibo: after the office admits the file
-
Send any missing documents the office requests, or the file can be archived: normally within 10 days of the request
-
Last chance to file late; you are in an irregular situation from expiry until you file: up to 90 days after the card expires
Documents you need
-
Filing receipt (justificante de presentación), issued by the office when you file. It shows the filing date and file number and proves the renewal was filed.
-
Admission notice (admisión a trámite) or acuse de recibo, sent by the administration after filing. It shows the file is in progress and the extension applies.
-
Your expired residence card, shown together with the receipt or admission notice.
-
Letter or certificate of file status (certificado de situación del expediente), which some offices issue on request. Ask the office that holds your file.
Evidence to carry while your renewal is pending
-
Keep the filing receipt (justificante de presentación) with you.
-
Keep the admission notice (admisión a trámite) or acuse de recibo once the office sends it. It shows the file is in progress and your stay is extended.
-
Carry your passport and your expired card, and show them together with the receipt or admission notice.
-
Carry the printed or digital application, plus your work contract, latest payslips or proof of self-employment, and your empadronamiento (town hall registration) certificate.
-
Print your documents and keep phone copies as a backup. Printed copies are safer at border checks, and police officers decide case by case.
-
Answer any requerimiento (a request for missing documents) quickly. You normally have 10 days to send them, or the file can be archived.
-
Check your file status online using the file number, or your NIE and date of birth, on the Ministry's service for foreigners' files. A digital certificate or Cl@ve also shows your notifications.
-
If you lose the receipt, download it again from the electronic office or Carpeta Ciudadana, or ask the office or registry where you filed for a copy of your application and receipt.
-
Ask the Oficina de Extranjería or Subdelegación del Gobierno that holds your file for a letter or a certificado de situación del expediente (file status certificate). There is no standard certificate, and offices differ on whether they issue one.
-
Give your employer a copy of the expired card and the receipt or admission notice for your employee file. A pending renewal filed on time is not a reason to suspend or dismiss you.
-
Show the receipt with your expired card and passport to the Social Security offices (TGSS, INSS), the unemployment office (SEPE) and the AEAT, Spain's tax agency. Your NIE does not expire with the card, so tax filings are unaffected.
-
Take the receipt to the admin desk of your health centre or regional health office if your tarjeta sanitaria shows the old expiry date. Your right to healthcare continues.
-
If an employer or bank refuses the receipt, ask for a letter from the Oficina de Extranjería confirming the extension and show it to them.
-
If a bank still refuses, complain to its customer service department. If there is no reply within 1 month or the answer is unsatisfactory, go to the Banco de España claims department.
-
If an employer still refuses, raise it with HR, then contact the labour inspectorate (Inspección de Trabajo). If you are dismissed, you must challenge it within 20 working days.
What to watch out for
-
Filing after expiry breaks your status: If you file after the card expires, you are in an irregular situation until you file. The authority may open a sanction procedure, which usually ends in a fine rather than expulsion. File during the 60 days before expiry. If you are already past expiry, file as soon as possible, within 90 days.
-
Filing more than 90 days after expiry: The renewal is normally refused as out of time, and you must apply for a new authorisation, for example through arraigo. Do not wait past 90 days. If you are close to the limit, ask the Oficina de Extranjería about your options.
-
Missing a request for documents: If you do not answer a requerimiento, the file can be archived and the renewal lost. Send the missing documents within the 10 days you normally have.
-
Treating the final resolution as proof of pending status: The resolution grants or refuses the renewal and is a separate document. Only the filing receipt and admission notice prove the file is pending.
Frequently asked questions
Can I get an official certificate saying my permit is extended?
No, there is no standard certificate that confirms the extension. In practice the filing receipt or the admission notice, shown with your expired card, is accepted as proof.
Does my NIE stop working when my card expires?
No, your NIE number stays the same for life and does not expire with the card.
Does my right to work continue while the renewal is pending?
Yes, if you filed in time and your permit allowed work, that right continues until the office resolves the renewal. The extension covers the rights the authorisation gave you.
What if the office sends me a final resolution instead of an admission notice?
The resolution is a separate document that grants or refuses the renewal, and it is not the same as the admission notice. Once it arrives, it replaces the receipt as the document that shows your position.
